1. Scope and who we are
Luxury Yacht Sardinia operates the website luxuryyachtchartersardinia.com, presenting 97 yachts across superyacht, yacht, sport-yacht, day-boat and catamaran categories for crewed charter in Sardinia, with day rates from €1,720. We arrange and confirm charters directly with clients; we do not operate as an online marketplace taking payment on behalf of unrelated third parties.
These terms apply to any charter enquiry or booking made through the website, by email, phone or WhatsApp. Questions about a booking or about these terms can be sent to [email protected].
2. From enquiry to confirmed booking
A booking does not exist until it is confirmed in writing. The process works as follows:
- You send an enquiry through the website form (name, email, optional phone, optional yacht choice, charter dates, guest numbers and a message) or contact us directly by email, phone or WhatsApp.
- We reply with a written quote stating the yacht, dates, price, what is included and what is charged as an extra.
- The booking is confirmed only once we have issued written confirmation and received the payment or deposit described below.
No charter is held or guaranteed on the strength of an enquiry alone, and availability shown on the website is indicative until confirmed in writing.
3. Prices and what's included
The price stated in your written quote is the price of the charter, including the vessel, skipper and crew as applicable to that yacht. Fuel, marina and port fees, the advance provisioning allowance (APA) on larger yachts, catering and any other extras are charged exactly as set out in the written quote.
We do not add charges that were not quoted. If your plans change and additional fuel, catering or stops are required once on board, any extra cost will be agreed with you before it is incurred, where practically possible.
4. Payment and deposit
Bookings are not paid online through the website. Payment is arranged directly with our team after you receive your written quote.
- Day charters are confirmed on receipt of full payment.
- Charters of two days or more are confirmed on receipt of a 50% deposit, with the balance due as agreed in the written confirmation.
No booking is held as confirmed until the applicable payment has been received and acknowledged in writing.
5. Right of withdrawal and cancellation by the client
Charter bookings are contracts for a leisure service to be performed on a specific date. Under Article 16(l) of Directive 2011/83/EU, implemented in Italy by Article 59 of the Consumer Code (Legislative Decree 206/2005), the general 14-day right of withdrawal that applies to most distance contracts does not apply to this type of booking. This is a feature of consumer law generally, not a term we impose.
In its place, we apply a clear voluntary cancellation policy that gives you the same certainty:
- More than 7 days before departure: full refund.
- Between 48 hours and 7 days before departure: 50% refund.
- Less than 48 hours before departure: no refund.
Refunds due under this policy are processed within 14 business days to the original payment method. Changes to dates or the chosen yacht requested by the client are treated as a cancellation and new booking unless we agree otherwise in writing.
6. Cancellation or changes by us
We may need to cancel or amend a charter for reasons outside normal commercial control, including adverse weather, a port authority restriction, a technical issue affecting the yacht, or other force majeure events.
- If the captain or the port authority considers conditions unsafe, the client chooses between a free new date and a full refund.
- The captain's safety decision is final and is not open to negotiation on the day.
- If we cancel for a technical or operational reason on our side, we will offer the same choice of a new date or a full refund.
We will tell you as early as practically possible if a charter needs to be rescheduled or cancelled for any of these reasons.
7. Guest capacity and safety rules
The number of guests on board may never exceed the vessel's licensed capacity, regardless of the number requested at enquiry stage. The crew may refuse boarding to anyone whose condition or conduct would endanger the safety of guests, crew or the vessel.
Guests should follow crew instructions on safety equipment, swimming areas and movement around the yacht at all times, particularly during tender use, watersports or stops near beach clubs.
8. The captain's authority and itinerary
The captain has full authority over the yacht, the route and the day's schedule, and may alter or shorten the itinerary for reasons of safety, weather, sea conditions or port regulations. This authority cannot be overridden by guests.
Where possible, itineraries are planned around how the day is actually spent on the water rather than a fixed route alone — pairing the chosen yacht with the right stops for swimming, tenders and water toys, from the shallow anchor fields around the Maddalena to arranged stops near the coastal clubs of Costa Smeralda. Crew are briefed on toy inventory and club timings in advance so the plan matches the vessel and the guests, but the captain may still adjust any stop on the day for safety or operational reasons.
9. Conduct on board, damage and personal belongings
Guests are expected to behave reasonably and follow crew instructions throughout the charter. The captain may end a charter early, without refund for the remaining time, if a guest's conduct endangers safety or seriously disrupts the charter for others.
- Clients are responsible for damage to the yacht, its equipment or tenders caused by guests through negligence or misuse during the charter.
- Personal belongings brought on board remain the guest's own responsibility; we do not accept liability for loss of or damage to personal items left unattended.
Any damage or missing item should be reported to the crew before disembarkation so it can be recorded accurately.
10. Liability
We arrange and operate charters with properly crewed vessels and qualified captains, but sea travel carries inherent risks that cannot be eliminated. Our liability is limited to the direct consequences of our own fault in arranging or operating the charter, and does not extend to loss caused by weather, sea conditions, decisions taken by the captain for safety reasons, or circumstances of force majeure.
We do not accept liability for indirect or consequential loss, such as missed onward travel, or for loss of personal belongings as set out above. Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by proven negligence.
11. Complaints
If something about your charter was not as agreed, please raise it with the crew at the time where possible, so it can often be resolved on the day. For anything that cannot be resolved on board, write to [email protected] with the booking details and a description of the issue, and we will respond in writing.
We aim to address complaints promptly and will explain our position clearly, with reference to the written quote and confirmation for that booking.
12. Website use, governing law and changes to these terms
The content of luxuryyachtchartersardinia.com, including yacht descriptions, images and pricing, is provided to help clients choose and enquire about a charter; it may be updated or corrected at any time and does not itself constitute a binding offer until confirmed in writing for a specific booking. The website and its content may not be copied or reused for commercial purposes without our written consent.
These terms are governed by Italian law. Any dispute will be submitted to the courts of Italy, except that a client who is a consumer resident in another EU member state may bring proceedings before the courts of their own place of residence, as EU consumer protection rules allow.
We may update these Terms and Conditions from time to time to reflect changes in how we operate; the version published on the website at the time of your enquiry applies to your booking, and any charter already confirmed in writing remains governed by the terms in force when it was confirmed.
